Utah Code § 30-2-5

  • 2024 Codification: Utah Code § 81-3-105 (effective Sept. 1, 2024).
  • Governs: Establishes that one spouse is not personally liable for the separate debts, obligations, or liabilities of the other spouse, including debts incurred before marriage, during marriage (except for family expenses), after divorce or separate maintenance, or assigned by court order. The statute also protects one spouse’s wages, earnings, property, rents, and other income from being reached by the other spouse’s creditors for those separate debts.
