• Governs: Modification or termination of a noncharitable irrevocable trust by consent. It provides that a noncharitable irrevocable trust may be modified or terminated upon the consent of the settlor and all beneficiaries, even if the modification or termination is inconsistent with a material purpose of the trust. It also governs who may exercise the settlor’s consent if the settlor lacks capacity.
